TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3D REALITY LABS AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID US (IF ANY) FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (WHICH MAY BE ZERO FOR INFORMATIONAL USE OF THE SITE).

8. Indemnity

You will defend, indemnify, and hold harmless 3D Reality Labs and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms, to the extent permitted by law.

10. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which 3D Reality Labs LLC is organized, without regard to conflict-of-law principles, except where prohibited. You agree that courts in that jurisdiction (or another venue we specify in writing for a particular dispute) have exclusive jurisdiction over disputes arising from these Terms or the Site, subject to mandatory consumer protections where applicable. Replace this section with the governing law and venue your counsel recommends.
